STANDARD TERMS AND CONDITIONS OF SALE


MOANS Couture is an artisan brand specializing in rhinestone, poured glass, blown glass jewelry, and custom-made pieces. Each piece is meticulously crafted, ensuring exceptional quality and artistry. Rhinestone designs often feature vintage cabochons, substituted with similar ones when unavailable, and are produced in limited quantities or as one-of-a-kind pieces. Poured glass pieces are hand-crafted without molds, giving each item its own unique characteristics, while blown glass jewelry showcases natural variations in color and texture. Buyers should not expect every piece to be identical to the pictures due to the artisanal nature of the work.

For clients who livestream or sell to live streamers, having the actual pieces in inventory is essential, and availability for exact or similar reproductions should be confirmed. MOANS Couture offers a credit for unsold items after 6-9 months, though this is rare as our designs cater to a niche audience that values exclusivity. If unsold items persist, it may indicate a misalignment with our brand’s aesthetic.

Specific Terms and Conditions:

  1. All pre-order items require a 50% non-refundable deposit, with the final payment due upon completion. For international clients, snapshot pictures of pieces can be provided, but this does not allow for order cancellations.
  2. The client explicitly waives its own standard terms and conditions, even if these were drawn up after these standard terms and conditions of sale. Any derogation must be expressly agreed to in advance in writing.
  3. Invoices are payable within 21 working days, unless another payment timeframe is indicated on the invoice or order. In the event of non-payment by the due date, MOANS® reserves the right to request a fixed interest payment amounting to 10% of the sum remaining due. MOANS® is authorized to suspend any provision of services without prior warning in the event of late payment.
  4. If a payment is still outstanding more than sixty (60) days after the due payment date, MOANS® reserves the right to call on the services of a debt recovery company. All legal expenses will be payable by the client.
  5. Certain countries apply withholding at source on the amount of invoices in accordance with their internal legislation. Any withholding at source will be paid by the client to the tax authorities. Under no circumstances can MOANS® become involved in costs related to a country's legislation. The amount of the invoice will therefore be due to MOANS® in its entirety and does not include any costs relating to the legislation of the country in which the client is located.
  6. MOANS® undertakes to do its best to supply performant services in due time in accordance with the agreed timeframes. However, none of its obligations can be considered as being an obligation to achieve results. MOANS® cannot under any circumstances be required by the client to appear as a third party in the context of any claim for damages filed against the client by an end consumer.
  7. In order for it to be admissible, MOANS® must be notified of any claim by means of a letter sent by recorded delivery to its registered office within 8 days of the delivery of the goods or the provision of the services.
  8. All contractual relations will be governed exclusively by United States law.
